1. Agreement to Terms

By accessing or using Eidos (the "Software," "Service," or "Application"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Software.

2. License and Usage

A. Software License

Eidos is an extensible framework for personal data management. The core software is available as an open-source project. Specific enterprise features or cloud services may be subject to additional licenses or fees.

B. Spark License

The "Spark" license is a one-time purchase that unlocks advanced features. This license is tied to your account and is for personal use.

3. User Data and Content

You retain all rights to any data, content, or information you store or manage through Eidos. Eidos does not claim ownership of your data. You are responsible for maintaining backups of your local data.

4. Prohibited Conduct

You agree not to:

  • Use the Software for any illegal or unauthorized purpose.
  • Attempt to interfere with the proper functioning of the Software or its cloud services.
  • Bypass any measures we may use to prevent or restrict access to the Software.

5. No Warranty

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.

6. Limitation of Liability

In no event shall Eidos or its developers be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Software.

7. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

8. Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
